The American Society for Testing and Materials (ASTM) the All Appropriate Inquiry (AAI) Rule (August 26, 2004 Draft), as well as the National Association for Environmental Professionals (NREP), have established guidelines and standards for the preparation of Phase I and Phase II property assessments. These guidelines establish customary practice for conducting environmental site assessments. One function of these assessments performed in accordance with these guidelines, is to satisfy the innocent landowner defense (due diligence) allowed by CERCLA 1and MTCA 2. In addition to meeting these requirements, any initial assessment of property allows the developer to better ascertain any associated liability prior to property closing.
EMS through its associates and owner have completed hundreds of Phase I Environmental Site Assessments, Phase 2 Environmental Investigations including sub-surface soil and groundwater investigations, underground storage tank site decommissioning projects and many subsequent soil and groundwater investigation and remediation projects.
